Car is declared a total loss..='c

    Sad news, after a week of repair estimation and investigation since my car got stolen, my car was declared today a total loss from my insurance adjuster.
    I feel like I loss a leg because of this, I know its only a material thing as we speak but this tC was my first car that im proud of that I've own by myself and it has great sentimental value from me since I babied this car from day 1 after I bought it a while back in 2007. I guess today is were sadly parting apart.
    I have some questions re: this matter since it's my first car that has been totaled.
    1. Car still have aftermarkets as of now, stereo, wheels, spacers, short shifters, etc. Will I ever able to get it, and put back all the original parts on the car? I asked this to my insurance adjuster, but he told me that I cant touch or remove all the aftermarket items that I put on my car since the tC is now their property. He told me that we can talk about this later on but as of now I cant get anything from it except personal items that I left in the car. Is this really true?
    2. Car still owe 4 grand from the bank and I don't remember if I got gap insurance when I bought the car, so far they still reviewing how much is the value of my car. I don't know if ill be responsible for that amount from my lien holder?
    I really need your input on this guys, for those already experienced this kind of situation.

    Dang that sucks. So the people who stole it totaled it or what? And I think that kind of stuff must vary from company to company, but when I totaled my truck they said I could grab the stereo out of it, I would assume that Untill you sign the papers they send you saying how much money they will pay you for the car, the car is still legally yours, but I'm not 100% sure of this. You should be able to just tell them how much the parts are worth and they will varify with the price adjuster and he will tell them what he thinks they are worth. When I totaled my other tC, I told them that it had the $1,000 oem lip kit on it and the $2,000 trd wheels, the $300 spoiler, and the $300 trd intake and they upped their original offer of 13,800 to 16,500 so just make sure you get money for the parts if they don't let you take them off, otherwise I would fight it. I'm sure you could fight it if you have the OEM parts to replace them with, if they are going to give you toe price of the car as if it was stock.

    They havent done any mechanical check yet, just the repair estimate on their own which he stated that its not repairable. He even said that their still waiting for the body shop appraisal for the repair, but they said they will do some test, fulids, etc. on the engine but he is pressuring me to release the car from the body shop if i dont want to pay storage fees. Before this thing happened, i already planned to go out of the country for a month starting monday and i told them that as well so i need to know whats going to happen with my car. He said that i cant keep a salvage car. Im really confuse on this.
    I dont have the oem exhaust and springs but i have the stock struts..
    They cant give me a blue book value yet since i told them that i will put the other oem parts on the car so they will do estimation again but im running out of time to do all this things.. Do i have the option to settle this case once i get back?
    Is there anywhere to store it where you live? Idk, you're gonna have to talk to some other people about this. I know when my friend totaled his car, he stored it in his garage for a few weeks, then got it appraised and got his money lol

    I called my insurance adjuster and told him that i called the insurance bureu regarding my case and trying to get a second opinion on this matter, i didnt know that its my right to choose to store my car back in my place which he didnt give that option to me earlier. And i am still entitled with the car even if its salvaged or not which is again he clearly insist that i CANT keep the car. As soon he heard about it he gave me a excuse that he is driving right now and he will call me back again later today. I cant believe this people trying to take advantage from me.. Ive been loyal to them for almost 9 years and this is what i will get from them...im still going to call my bank today to inform them that my car was totalled and my insurance will pay what i still owe from them..

    hey I was reading about your loss before, sorry that sucks bro! but about the insurance, had to jump in here to tell you it's all a game to that adjuster. The inside story is that they get bonuses and extra commission so to speak if they adjust you lower than what you should get paid. Because if the insurance can pay less, they make more money. It's a twisted industry indeed. That guy will play so many games, tell so many lies, all based on HURRY UP AND GET THIS DONE NOW!! WE CANNOT WAIT!.. I remember I played this game with an adjuster before, wanted to give me black book for a car I just got 6 months before.

    here I paid 9k six months before and the guy only wanted to give me $2500 six months later? You gotta be kidding me. Oh yeah guy was telling me that his offer is all the company would give me, and either I took his offer or I got nothing. All lies, of course. What people don't know is that you can go above the adjuster, you can even sue the insurance company. Those things they don't want you to know because since your car was your baby (they can tell you really cared about the car, since most people think they can be HONEST with the insurance company and tell them all about how they cared for the car, etc).. they use this vulnerable time against you.

    I do like the idea of moving the car to storage until you decide their offer is good enough to take. Oh back to the 6 month old car that was totalled the guy was getting pressure from his higher ups since it was not resolved 5-6 weeks after the accident! I held out and got the $9k back! So just remember what this guy says it's not in your best interest, it's in his best interest and the insurance company's best interest!

    Yes you can keep a salvage car, the insurance company DOES NOT OWN your car at all, the bank does. But as you're finding out, they're leaving a lot out. Good lesson that you can share this with everyone here, people need to know what it's like. Not that we want to lose our cars but need to know what to expect from insurance.

    Again bro, sorry about your loss, but it pisses you off that it's bad enough it was stolen then you get some slimy insurance guy (reminds me of used car salesmen) trying to lie to you. don't let this guy pressure you, let him wait.. they have to pay you, that's why you have insurance.
    What actually happened? I saw your thread about the car getting stolen...did they wreck it?

    I don't have much useable advice but i was under the impression that when you wreck your car, you can take your parts off but replace them with OEM, or you have to leave them on the car. Once the car becomes property of the insurance company, they get the full car.

    I just spoke with my friend's uncle that have a great knowledge how to deal with the insurance adjuster like this, and suprisingly funny he said almost the same about the "adjuster mind game". He told me the tricks and the right words to said if i ever have to deal with them again next week. He used to work with the insurance company for how many years and just get tired with the insurance politics and quit. After listening to him what he just explained to me it made me more confident to deal with him. When i told that they claim the car totalled without showing any proof how and why they claim it total loss, my friend's uncle cant hold his self laughing and said that's totally BS!. It is my right to have a copy of whatever physical damage appraisal of they car if they claim it total..So instead of him pressuring me now i will put the pressure back to him since my car is fully covered with my insurance...i hope i have a clear answer next week. Sorry guys i forgot to upload of the car after they recovered it in castro valley..Good thing i thank about is, most of my aftermarket parts is still there. But as far of any mechanical damage i dont know yet..
